Terms of Service for Fridge to Frame

Introduction

Welcome to Fridge to Frame, operated by Forward Alpha LLC (“we,” “our,” or “us”).
These Terms of Service (“Terms”) govern your access to and use of the Fridge to Frame mobile application (the “App”) and related services.
By accessing or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

1. Eligibility

You must be at least 13 years old to use this App.
By using Fridge to Frame, you represent that you meet this age requirement and have the legal authority to agree to these Terms.

2. Account Registration

To access certain features, you may need to create an account. When you do:

  • You agree to provide accurate, current, and complete information.

  • You are responsible for maintaining the confidentiality of your login credentials.

  • You agree not to share your account with others or use another person’s account.

We reserve the right to suspend or terminate your account if we believe it violates these Terms.

3. App Functionality

Fridge to Frame allows users to upload images (such as drawings or photos) and transform them using AI technology provided by OpenAI and other service providers.

You can:

  • Upload original artwork or images you own rights to.

  • View and manage your transformations within the App.

  • Save, delete, or share your generated images.

You may not:

  • Upload images that infringe on others’ intellectual property rights.

  • Use the App for any unlawful, harassing, or abusive purpose.

  • Attempt to reverse-engineer, resell, or misuse the App’s AI processing features.

4. Subscriptions and Payments

Fridge to Frame offers free and paid tiers.

Free Tier

Limited features and local storage of your transformation history.

Paid Plans

Offer additional credits, cloud syncing, and extended functionality.

  • Payments are processed securely through Apple App Store and managed by RevenueCat.

  • Subscription renewals and cancellations must be managed through your Apple ID settings.

  • We do not offer refunds for partial subscription periods unless required by law.

5. User Content

You retain ownership of the images and content you upload to Fridge to Frame.

By uploading content, you grant us and our service providers (such as OpenAI and Firebase) a limited, worldwide, non-exclusive license to:

  • Process your images for transformation and enhancement,

  • Store them as part of your account and history,

  • Display them back to you within the App.

We do not claim ownership of your creations or use them for AI training without your explicit consent.

You are responsible for ensuring that your uploads:

  • Do not violate copyright or privacy rights,

  • Are appropriate for public AI processing,

  • Comply with all applicable laws.

6. AI-Generated Content

AI-generated images are produced using third-party technology (including OpenAI).
While we strive for quality and accuracy, AI outputs may not always be perfect, realistic, or suitable for all purposes.

You understand and agree that:

  • Results may vary depending on the image and transformation prompt.

  • We are not responsible for unintended, inaccurate, or offensive outputs.

  • You use AI-generated content at your own discretion.

7. Data and Privacy

Your use of the App is also governed by our Privacy Policy (linked in the App and available at theforwardalpha.com/privacy).
The Privacy Policy explains how we collect, use, and safeguard your information, including AI-generated images.

8. Intellectual Property

The App, including its design, code, and branding, is the property of Forward Alpha LLC and its licensors.
You may not copy, modify, distribute, or create derivative works based on any part of the App except for your own generated content.

All rights not expressly granted are reserved.

9. Termination

We may suspend or terminate your account or access to the App if:

  • You violate these Terms or applicable laws,

  • You misuse or abuse the App’s features,

  • We discontinue the service for operational reasons.

Upon termination:

  • Your access to cloud-synced data may be removed,

  • Any locally stored data will remain on your device until deleted by you.

10. Disclaimers

Fridge to Frame is provided “as is” and “as available.”
We make no warranties, express or implied, about:

  • The accuracy or reliability of AI outputs,

  • Uninterrupted availability of the service,

  • Compatibility with your device or system.

You use the App at your own risk. We are not responsible for any loss or damage resulting from your use of the App or reliance on generated content.

11. Limitation of Liability

To the maximum extent permitted by law, Forward Alpha LLC and its affiliates are not liable for:

  • Indirect, incidental, or consequential damages,

  • Loss of data, profits, or goodwill,

  • Errors or omissions in content,

  • Issues caused by third-party services (e.g., OpenAI, RevenueCat, Firebase, or Apple).

Our total liability under these Terms shall not exceed the amount you paid (if any) for using the App in the 12 months preceding the claim.

12. Indemnification

You agree to defend, indemnify, and hold harmless Forward Alpha LLC and its affiliates from any claims, losses, damages, or expenses arising from your use of the App or violation of these Terms.

13. Changes to These Terms

We may update these Terms periodically.
Changes become effective when posted in the App or on our website.
If we make material changes, we will notify you via in-app notice or email.
Continued use after changes means you accept the updated Terms.

14. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law principles.
Any disputes shall be resolved exclusively in the state or federal courts located in Los Angeles County, California.
